Summary:
This series consists of documents constituting the whole proceedings for a case seeking repeal of a letters patent or dissolution of articles of incorporation. Information includes the cases' history, the defendant's defense, statements of facts, actions taken by, and the final judgment of the court. Documents include summonses; plaintiff's complaint; the defendant's answer; court orders; affidavits; and judgment. Each record contains the name of the case, name and location of the court, presiding judge and filing date.

Administrative History

Chapter 438 of the Laws of 1849 specified that records relating to repeals of a letters patent or to dissolving of articles of incorporation be filed in the Office of the Secretary of State whenever judgment was rendered against the defendant. If the case related to a letters patent the secretary of state was required to make an entry in the records of the commissioner of the land office noting that the patent was vacated. If it related to articles of incorporation he was obliged to publish the results and particulars of the judgment. It was also the duty of the attorney general immediately after the rendering of any decision amending any act of incorporation to institute proceedings for that purpose.

Scope and Content Note

This series consists of copies of documents constituting the whole proceedings or judgment roll in a scire facias case seeking repeal of a letters patent or to dissolve articles of incorporation. The documents included in each record provide, in narrative form, the history of the case including the plaintiff's reason for bringing suit, the defendant's defense of his actions, statements of facts bearing on the case, actions taken by the court and the final judgment of the court.

The documents contained in a record of judgment are usually: summonses; the plaintiff's complaint; the defendant's answer to complain; court orders; affidavits; and judgment. The name of the case, name and location of the court, presiding judge and date of filing of each document are given in each record.
