Administrative History

The New York State Department of Social Services Division of Legal Affairs acted as the legal advisor to the department and Commissioner of Social Services and was responsible for all legal matters concerning the department and its programs. Major responsibilities included providing legal assistance and support for lawsuits affecting the department; providing legal support for the articulation of department policy through state legislative and regulatory processes; representing the department in federal legislative and regulatory processes; conducting hearings on various services administered by the department in order to review local district determinations; conducting special hearings on issues pertaining to fraud and abuse; and providing legal services required for operation of the department's programs.

Scope and Content Note

This series consists of proposed regulations which were prepared by various programs within the Department of Social Services and sent to central counsel's office for review and filing with the New York State Department of State. The files include the draft and final text of proposed regulations; prepared regulatory flexibility and impact statements consistent with the State Administrative Procedures Act; comments on the proposals from the program units, other agencies, and the general public; and comments and legal opinions on the regulations from central counsel's office staff.

Subjects of note in these records include medical services, rules and regulations of day care and family care centers, child welfare, youth facilities, food stamp programs, alcoholism and drug abuse rehabilitation and support, and foster care.
