Scope and Content Note
During the time period in which these records were created, the Court for the Correction of Errors (Court of Errors) handled only cases from the State's principal courts of law (Supreme Court) and equity (Chancery Court). The records consist of draft judgments rendered by the Court of Errors in law cases appealed from the Supreme Court and draft decrees issued by the court in equity cases appealed from the Court of Chancery.
Draft judgments typically include names of plaintiff in error and defendant in error; date of judgment; whether Supreme Court's judgment is affirmed or reversed; specific orders regarding the recovery of court costs by the victorious party; specific orders regarding interest due the victorious party stemming from the delay caused by the appeals process; and an order that the record and proceedings be remitted to the Supreme Court "there to be proceeded upon according to law."
Draft decrees typically include names of appellant and respondent; date of decree; whether Chancellor's decree is affirmed or reversed; specific orders regarding the recovery of court costs by the victorious party; specific orders regarding interest due the victorious party stemming from the delay caused by the appeals process; and an order that the record and proceedings be remitted to the Court of Chancery "there to be proceeded upon according to law."
