Appeal of Cornelis van Langevelde of a judgment of the court of New Amsterdam in favor of Janneken Heermans

Petrus Stuyvesandt, on behalf of their honorable High Mightinesses the lords States General of the United Netherlands and the lords directors of the Chartered West India Company, chamber of Amsterdam, director general of N. Netherland, Curaçao, Bonaire, Aruba and the dependencies thereof, together with the honorable lords councilors, have summoned hereto the court messenger Claes van Elslant, greetings.

Whereas Cornelis van Langevelde has remonstrated to us by petition that he finds himself aggrieved and injured by the judgment handed down by the honorable court of this city, dated the first of October, last past, between him and Janneke Heermans for reasons stated in the attached copy of the petition. For which reason he requests our assistance.[1]

Therefore, we order you to summon the aforesaid Janneke Heermans to appear, or to send deputies, before us here in Fort Amsterdam in order to respond to such demands and rejoinders, in addition to the request of the appellant to be exempt from the intervening cost of his appeal, which the aforesaid Cornelis van Langevelde shall make and effect at that time, inviting those of the aforesaid court to appear (if it pleases them) on the aforementioned day, or to send deputies to see us annul or confirm the aforesaid judgment; providing copies for use of the parties, and relating to us what you encounter.[2]

Thus done and issued in Fort Amsterdam in New Netherland the 22d of December 1661.

Notes

Van Langevelde had been ordered to return the pearl earrings which Janneke Heermans claimed she had given to Balthus Loockermans to sell at Fort Orange. See RNA, 3:369.
The council ordered Van Langevelde either to return the pearls or money equal to the value of the pawn; see NYCM, 101:20.
