Administrative History

The Office of Hearings and Mediation Services (OHMS) is an independent office with the Department of Environmental Conservation that reports directly to the Commissioner. OHMS conducts hearings related to the Department's permitting and enforcement activities under the Environmental Conservation Law. The office also resolves environmental disputes by employing less formal means, such as mediation, and decides all Freedom of Information Law (FOIL) appeals.

Scope and Content Note

This series consists of a hearing file for the Department of Environmental Conservation's hearing on the application of the New York City Department of Environmental Protection for a water supply permit for drought emergency operation of the Hudson River Pumping Plant at Chelsea, New York. The application was Water Supply Application number 7620 and DEC Application number 00-85-0003. Commencing in 1987, the case was closed in May of 2002, when the New York City Department of Environmental Protection withdrew the application. Records in the series include hearing notices; emergency declarations; correspondence; public comments; briefs; exhibits; draft reports; adjudicatory hearing transcripts; testimony; and draft environmental impact statements.

17067-12: This accretion consists of hearing testimony, correspondence, exhibits, reports, and other records documenting the results of adjudicatory and legislative public hearings held by the New York State Department of Environmental Conservation in accordance with the Environmental Conservation Law (ECL) or by direction of the Commissioner. The bulk of the accretion is concerned with solid waste disposal in Saint Lawrence County.
