Administrative History

On September 14, 1989, Governor Mario Cuomo issued an executive order (No. 129) creating a Moreland Act Commission to Investigate the Operation and Administration of the Returnable Container Act. The commission was charged with investigating and determining how well the act was working; the adequacy of state enforcement; the costs of compliance with the act; and whether unclaimed deposits should be retained by the beer and soft drink industries or paid to the state. The commission was also charged with making recommendations on how to improve the efficiency and effectiveness of the act.

This series contains correspondence from interest groups as well as state and New York City agencies; research files (Rockefeller Institute reports 1984, 1988); material from New York State legislative assembly hearings; returnable container legislation from other states; press releases and clippings; and material documenting commission hearings.

Acquisition Information

After retention in inactive storage at the State Records Center, custody of these records was transferred to the State Archives during January, 1997. Records appearing on transfer list 4-90 remain at the State Records Center until space becomes available at the Archives.

Access Restrictions

Restricted in accordance with Civil Rights Law, Section 73.8, and other statutes. Public hearing transcripts, press releases, published material, and other records that have been previously available to the public are available without restriction. Access to other information is permitted only by permission of the commission or the Governor's office.
