The Temporary State Commission on Eminent Domain and Real Property Tax Assessment Review was originally created by the legislature (Chapter 621 of the Laws of 1970) to reevaluate the laws dealing with eminent domain. The aim was to recodify those laws to provide more speedy procedures for determining prompt and just compensation to the property owner for real property taken for public purposes.

Additional legislation in 1974, (Chapters 992, 1078, and 1079) expanded the commission's mandate to include the investigation and review of existing laws and procedures relating to real property tax assessments and contested tax assessment upon real property.
