Administrative History

The Equitable Adjustment Act (Chapter 328 of the laws of 1969) was an amendment to the public buildings law relating to construction and improvements of public buildings and facilities in the Albany South Mall Project. This Act authorized the commissioner of general services to grant an equitable adjustment in construction contracts where the commissioner determined that the performance of all or any part of the work has been suspended, delayed, or interrupted by an act or omission of the state. For these delays, an equitable adjustment was made for any increase in the cost of performance of the contract and the contractor was able to apply for the adjustment. This act remained in full force and effect through Marth 31, 1974.
